Terms and Conditions (the “Terms and Conditions“) are an integral part of the Website’s terms of use and both documents should be read together.

This document, together with all other documents, governs the terms of use of the Top Beauty website, as well as the terms of the public contract for the sale of goods and services through the Top Beauty website (“General Terms and Conditions”).

General terms and conditions are a formal proposal for the publication of public agreements, which defines all the essential terms of sales contracts.

  • General provisions and conditions of regulation of the Law of Ukraine “On Consumer Protection” № 1023-XII of May 12, 1991, the Law of Ukraine “On e-commerce” № 675-VIII of September 3, 2015, Rules for the sale of goods to order and out of trade or official premises approved by the Order of the Ministry of Economy of Ukraine № 103 of April 19, 2007, and other current laws of Ukraine.
  • All changes to the general terms and conditions are only valid for new updates made after the publication of such changes on this website.
  • The customer pays attention to checking the positions and conditions of the relevant sections before they place an order. 
  • By registering on this website, clients declare that they have read and understood the General Terms and Conditions, which they have marked and fully agreed with the terms and conditions set out in this document, and have been able to use the websites in accordance with such terms.
  • The right to use the websites is not transferred to other individuals or legal entities. The registered user is not personally responsible for the confidentiality of passwords in the applied cases.
  • As part of the use of the website, the customer will be required to provide the seller certain personal details including name, email address, phone number, and shipping address. Such information is stored by the seller in its CRM database and is used for internal use and future contact with its customers and necessary in order to process an order. Credit card details that will be requested are needed for purpose of purchase only and are not stored by the seller.
  • During website browsing and use, information regarding customers’ use of the website may be collected including services customers were interested in and pages they viewed. Such information is statistics and does not identify anyone.

1. What personal data do we collect and why do we collect it?

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

2. Payment conditions

2.1  We accept payment by credit cards Visa International and Mastercard Worldwide.

2.2 Our payment service provider reserves the right to decline the processing of payments in cases of suspected fraud or other irregularities.

2.3  In the section “Cart”, customers will be able to see the total amount of all picked products as well as delivery shipping cost based on weight. If the client confirms the total price, he should press “proceed to checkout” where a customer will be redirected to enter the billing address and see the entire order. After the customer presses “Place Order” the customer will be redirected to the payment system where the customer needs to enter credit card details. The customer is obligated to pay the amount due without delay in full, including any bank charges for a payment service provider. Seller’s acceptance of customer’s order, in this case, will be subject to receipt of your payment.

2.4  Under the “Payment Security” section below, we explain more in detail how payments are secured. Our payment services meet the standards: SSL -certificate, Cloudflare, PCI DSS – Level 1.

3.Delivery policy

3.1 We deliver items overseas using JSC Ukrainian Postal Service “UKRPOSHTA”.

3.2 The cost of shipping the order will be determined by the size of the order and varies according to the details of your order. The table under the section “Shipping Area” shows delivery prices according to the weight of the order.

3.3 These costs are added to the shopping cart before checkout.  Shipping times are estimated at between 7–14 business days for overseas orders.

3.4 An order from the website will be sent within 3-5 business days from the confirmation of the order.

4.Returns and Cancellations

4.1 ORDER THAT HAS NOT BEEN SHIPPED YET:  Any order that hasn’t been shipped can be canceled fully or partially. The amount paid by the customer will be refunded to the customer and should reflect in his account in 7-10 days.

4.2 ORDER WAS DAMAGED WHEN RECEIVED:  We take utmost care while packing to ensure that the product reaches the customer the way it is presented on the website. However, due to situations beyond our control, the items delivered might get damaged in transit. We can replace the order under such circumstances only if we get a request from the customer in advance within 48 hours of receipt of the order. Any refund will be done only after a proper check of damaged material.

4.3 INCORRECT ITEMS RECEIVED:  Please send an email to topbtystore@gmail.com with complaints details and we will replace the product for the next order or refund accordingly depending on the customer’s request.

4.4 Refund is made as follows: the amount is credited back to the same account from which the payment was made.

4.5 Cancellation of order: Top Beauty Store reserves a right to cancel any order under the situation where Top Beauty Store is not able to meet the requirements of the placed order. However, the seller will ensure that any communication of cancellation of an order, will be made within appropriate time to the concerned person and any applicable refund will be made in a reasonable time.

5.Cookies

5.1 If you leave a comment on our site you may opt-in to saving your name, email address, and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

5.2 If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

5.3 When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

User details provided by the customer will be bound to the Privacy Policy, and the Customer hereby agree that such information will be stored in the seller’s databases for the following purposes:

  • Marketing, advertising, sales promotion, addressing the User by any available media (including in writing, by phone, fax, electronic form, and any other form);
  • Encouraging loyalty, research and analyzing of statistics, conducting surveys and any other users regarding registration to the Website;
  • Internal uses including investigating complaints and/or reviews.
  • Operational marketing and statistical purposes including processing information and mailings for such purposes.
  • Providing services to Customer and ensuring fair and lawful trade.
  • The customer acknowledges that he has no legal obligation to provide the seller with such information and any providing of information is done at the customer’s consent. Furthermore, the seller may, for the above purposes, transfer such information which will not identify Customer, anonymous or aggregative, regarding customer’s use of the website, to entities that are collaborating with the seller’s activity and to any other entity which will provide services and benefits to the customer’s under the seller’s sole discretion.

8. How long do we retain your data?

8.1 If you leave a comment, this comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

8.2 For users that register on our website (if any), we also store the personal information they provide in their user profiles. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

9.What rights do you have over your data?

If you have an account on this site or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

  • In order to ship his/her order, and in such case customer’s shipping address will be transferred to the shipping company if customer’s order will be delivered via post;

This means that your confidential data (card details, registration data, etc.) is not transferred to us. Such data processing is completely protected and no one can receive specified cardholder data. When working with payment card data, the information security standard (Payment Card Industry Data Security Standard (PCI DSS) developed by the international payment systems Visa and Master Card is applied.

PCI DSS includes the implementation of Secure Sockets Layer (SSL) protocols and other security methods.

13.Data Security

13.1 The seller takes appropriate security measures for data security purposes to help prevent unauthorized persons from gaining access to your personal information. Therefore the seller does not warrant that its services will be totally immune to any breaches of security and/or unauthorized access, including access to the data stored on the Website.

13.2 The seller inspects, from time to time, the data security of the Website and performs modifications and upgrades accordingly in order to keep the Website’s security. Nonetheless, the seller will not be liable for any direct or indirect damage caused to the customer due to exposure of customer’s information by unauthorized access to the seller’s database and/or due to any negligence or act not controlled by the customer.

14.Changes to Terms and Conditions

The seller may occasionally update these Terms and Conditions.
